Terms & Conditions of Service

Welcome to Elevated Business Marketing. These Terms & Conditions (“Terms”) govern the provision of Website Hosting, Maintenance, Security, and SEO Services (“Services”) provided to you (“Client”) by Elevated Business Marketing (“Company,” “we,” “us,” or “our”).

By signing up for or using any of our services, you agree to be bound by the following terms:

1. Website Hosting

We provide managed website hosting services designed for performance and reliability. However, we cannot guarantee uninterrupted or error-free service. Factors such as third-party server issues, internet outages, or force majeure events may impact availability.

Service Inclusions:

  • Managed hosting on a secure server

  • Regular uptime monitoring and support

  • SSL certificate installation and renewal

We are not liable for damages or losses resulting from downtime, data loss, or third-party attacks.

2. Website Maintenance (1 Hour/Month)

Your monthly website maintenance plan includes up to 1 hour of technical updates or content changes per month. This may include plugin updates, theme adjustments, minor design tweaks, or content additions.

Terms:

  • Unused time does not roll over.

  • Requests exceeding the monthly allotment are subject to our standard hourly rate.

  • Major redesigns or custom development fall outside the scope of this service and require a separate agreement.

3. Website Security

We implement security measures designed to protect your website from common threats, including:

  • Firewall configurations

  • Malware scanning

  • Software and plugin updates

  • Regular backups

While we take proactive steps to secure your website, no system is entirely immune from cyber threats. We do not guarantee complete protection and are not liable for breaches caused by third parties or outdated client-supplied content or plugins.

4. Search Engine Optimization (SEO)

We use industry best practices to improve your website’s visibility and performance on search engines. Services may include:

  • On-page optimization

  • Technical SEO audits

  • Keyword research

  • Content and meta updates

  • Local SEO strategy

Important Disclaimer:
SEO outcomes are influenced by many factors, including search engine algorithm changes and competitor activity. We do not guarantee specific rankings, traffic volume, or conversions. Our services are designed to increase visibility and performance over time, but outcomes will vary by industry and market conditions.

5. Social Media Management

Your contract will specify your posting schedule. While we manage your social media content, you must coordinate any additional content or scheduling with our team. All policies outlined by Meta (Facebook and Instagram), Google, TikTok, Pinterest, YouTube, and other platforms must be followed by your entire company. The use of third-party content creation or engagement-boosting services is strictly prohibited while we manage your accounts, as it could put both companies at risk of account restrictions or bans.

All clients are required to provide one hour of video content per week. This content must be created and owned by you. You are responsible for obtaining and maintaining all necessary photo and video consents from any individuals appearing in the content. Elevated Business Marketing will not be held responsible for videos or photos that include individuals without proper consent. If any content contains audio or music, your company must ensure that all licenses are valid and maintained.

Elevated Business Marketing maintains all stock photo and video licensing, as well as the music provided within the apps we use for content creation. Clients are only responsible for their own content and any third-party materials they provide.

Elevated Business Marketing cannot be held liable for any loss, restriction, suspension, or removal of social media accounts due to actions taken by social media platforms, including the enforcement of community guidelines or automated AI moderation. Clients acknowledge that platform decisions are outside our control.

Please note that we do not guarantee specific rankings, traffic volume, or engagement. Our services are designed to improve visibility and performance over time, but results will vary depending on industry and market conditions.

6. Term Commitment & Cancellation

All new services require a minimum three-month commitment. After the initial term, services convert to a month-to-month agreement. To modify or cancel any service, a 30-day written notice is required. After the cancellation is received, an additional month of payment would be required, and once your account is settled, you will receive a notification of your final day of service. This would be calculated from your last month of services paid.

7. Payment Terms

  • Monthly service fees are due in advance on the agreed billing date.

  • Late charges of $25 minimum or 5% will be assessed if payment hasn’t been received within 2 days of your due date.

  • Additional services requested beyond the agreed plan will be billed at a new quoted or the standard hourly rate.

8. Limitation of Liability

To the maximum extent permitted by law, Elevated Business Marketing, LLC. shall not be held liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, profits, or website functionality resulting from use of or inability to use the services.

9. Modifications

We reserve the right to modify these Terms & Conditions at any time. Clients will be notified of material changes via email or client dashboard. Continued use of services after changes constitutes your acceptance of the revised terms.
